Our telehealth services ("Services") are provided through our website located at MDsByTheSea.com and our mobile application (collectively, the "Platform"). These Terms and Conditions ("Terms") govern your use of our Platform and Services, and by accessing or using our Platform, you agree to be bound by these Terms and our Privacy Policy. If you disagree with any part of these Terms, you may not access our Services.

Our Platform provides telehealth medical consultations and related healthcare services by connecting you with healthcare providers. By agreeing to these Terms, you acknowledge that you understand and agree to engage in telehealth services.

You must be 18 years of age or older to use our Services, or have the necessary consents from your parent or guardian if you are under 18. By using our Services, you represent and warrant that you have the right, authority, and capacity to enter into these Terms and to abide by all the terms and conditions set forth here.

To access certain features of our Services, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your account password and for any activities or actions under your account.

Our Services are intended for users located in certain jurisdictions only. Access to the Services may not be legal by certain persons or in certain countries. If you access the Services from outside our intended jurisdiction, you do so on your own initiative and are responsible for compliance with local laws.

The healthcare services provided through our Platform are delivered by licensed healthcare providers practicing within a group of independently owned professional practices collectively known as "MDs By The Sea, Inc. practitioners." These professional practitioners are independently responsible for the services they provide.

The Service and its original content, features, and functionality are and will remain the exclusive property of MDs By The Sea, Inc. and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of MDs By The Sea, Inc.

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

In no event will MDs By The Sea, Inc., nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

These Terms shall be governed and construed in accordance with the laws of California, without regard to its conflict of law provisions.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
