Terms and Conditions for MDs By The Sea, Inc.

Terms and Conditions

Last Updated: September 17, 2026

Welcome to MDs By The Sea, Inc., also operating as Telehealth Urgent Care at MDs By The Sea ("MDs By The Sea," "we," "us," or "our"). These Terms and Conditions govern your use of the website at www.MDsByTheSea.com and the telehealth services provided by MDs By The Sea.

By accessing our website, completing patient intake forms, or receiving services from MDs By The Sea, you agree to these Terms and our Privacy Policy.

1. Telehealth Medical Services

MDs By The Sea is a physician-owned telehealth urgent care practice serving patients who are physically located in California at the time of their medical visit.

Medical care is provided by California-licensed physicians through live, synchronous video visits.

At the beginning of the video encounter, the treating physician will identify themselves to the patient by name and professional credentials.

Telehealth may be appropriate for many medical conditions, but it is not appropriate for every condition. A physician may determine that you need an in-person examination, laboratory testing, diagnostic imaging, urgent care, emergency care, or evaluation by another healthcare professional.

Use of telehealth does not change the professional standard of care applicable to the physician providing treatment.

2. Telehealth Consent

Before receiving telehealth care, patients are informed that their medical care will be provided using telehealth and are required to provide consent to receive care through telehealth.

Telehealth consent is documented as part of the patient's medical record.

You may ask questions about telehealth before or during your visit.

3. California Location Requirement

MDs By The Sea currently provides telehealth medical services to patients located in California.

You must accurately disclose your physical location at the time of your medical visit. Your physician will confirm that you are physically located in California before providing medical treatment.

MDs By The Sea does not knowingly provide medical treatment to a patient located in a jurisdiction where the treating physician is not legally authorized to practice.

4. Medical Emergencies

MDs By The Sea is not an emergency medical service.

If you believe you are experiencing a medical emergency, including severe chest pain, difficulty breathing, symptoms of stroke, severe bleeding, loss of consciousness, or another potentially life-threatening condition, call 911 or go to the nearest emergency department immediately.

Do not use the MDs By The Sea website, text messaging service, or telehealth waiting room for emergency medical care.

5. Patient Eligibility and Minors

Adult patients may request telehealth services directly.

Patients under 18 years of age must have authorization or consent from a parent, legal guardian, or other person legally permitted to consent to medical treatment when required by applicable law.

Additional consent requirements may apply depending on the patient's age, condition, and type of medical service requested.

6. Patient Identification and Information

Patients may be required to provide information necessary to establish identity and provide medical care, including:

  • Full legal name
  • Date of birth
  • Address and telephone number
  • Government-issued identification
  • Health insurance information and insurance card
  • Current medications
  • Allergies
  • Medical history
  • Current symptoms and reason for the visit

You agree to provide complete and accurate information.

Providing incomplete, inaccurate, misleading, or false information may interfere with our ability to provide appropriate medical care.

7. Prescriptions and Medications

Completing an online questionnaire does not guarantee that a medication will be prescribed.

A physician must conduct a live video medical evaluation before prescribing medication through MDs By The Sea.

Medications are prescribed only when the treating physician determines that there is an appropriate medical indication and that prescribing is consistent with applicable professional standards and law.

MDs By The Sea does not prescribe controlled substances through its telehealth service.

Patients select their own pharmacy. When medically appropriate, prescriptions may be transmitted electronically to the patient's selected pharmacy.

MDs By The Sea does not own or require patients to use a particular pharmacy.

8. Laboratory Tests, Imaging, and Other Orders

When medically appropriate, an MDs By The Sea physician may order laboratory testing, diagnostic imaging, or other medical services.

Third-party laboratories, imaging centers, pharmacies, and other healthcare providers are separate organizations and may have their own charges, policies, scheduling requirements, and terms of service.

MDs By The Sea does not guarantee the availability, pricing, or performance of an independent third-party healthcare provider.

9. Medical Records

MDs By The Sea maintains medical records for patient encounters, which may include patient intake information, physician notes, diagnoses, treatment plans, prescriptions, orders, test results, and follow-up documentation.

Patients may request copies of their medical records from MDs By The Sea in accordance with applicable law.

10. Privacy

The privacy and confidentiality of patient information are important to MDs By The Sea.

Our collection, use, disclosure, and protection of personal and health information are described in our Privacy Policy and applicable privacy notices.

Patients acknowledge the applicable privacy notice during the patient intake process.

Electronic communications, including email and text messaging, may involve privacy and security risks. By choosing to communicate with MDs By The Sea electronically, you acknowledge these inherent risks.

11. Payment and Insurance

MDs By The Sea accepts participating insurance plans as well as self-pay patients.

For self-pay visits, payment may be required before the physician encounter.

If you use health insurance, MDs By The Sea may submit claims to your health plan when appropriate. Participation with an insurance company does not guarantee that every service will be covered.

Patients remain responsible for applicable copayments, deductibles, coinsurance, non-covered services, and other amounts for which they are legally responsible under their health plan.

Insurance coverage and benefits are determined by the patient's insurance company, not by MDs By The Sea.

12. SMS and Electronic Communications

If you provide a mobile telephone number and consent to receive text messages, MDs By The Sea may send communications related to your healthcare or interaction with our practice, including:

  • Check-in information
  • Appointment or visit notifications
  • Follow-up communications
  • Requests for additional information
  • Billing or insurance communications
  • Notifications regarding prescriptions, laboratory testing, imaging, or other orders

Message frequency varies. Message and data rates may apply.

You may reply STOP to stop receiving text messages and HELP for assistance.

If you opt out of text messages, MDs By The Sea may communicate with you using another permitted method when necessary for your care or administrative needs.

For assistance, contact:

admin@mdsbythesea.com
888-632-9732

Consent to receive promotional text messages, if any are offered, is not a condition of receiving medical care.

13. Follow-Up Communications

Patients may contact MDs By The Sea after a visit with questions regarding their treatment, prescriptions, laboratory orders, imaging orders, or other care-related matters.

Clinical questions may be referred to a physician when appropriate.

Telephone and text communications are not substitutes for emergency medical care.

14. Website Information

Information available on the MDs By The Sea website is provided for general informational purposes.

Viewing the website alone does not establish a physician-patient relationship and is not a substitute for an individualized medical evaluation.

A physician-patient relationship is established only when appropriate under applicable law and through the provision of professional medical services.

No particular diagnosis, treatment, medication, test, or medical outcome is guaranteed.

15. Third-Party Technology and Services

MDs By The Sea may use third-party technology providers to facilitate patient intake, video communications, electronic medical records, electronic prescribing, payment processing, and other healthcare operations.

Those services may be subject to separate privacy policies or terms maintained by the applicable provider.

Links to third-party websites are provided for convenience and do not constitute an endorsement or guarantee of the third party's services.

16. Patient Responsibilities

By receiving services from MDs By The Sea, you agree to:

  • Provide accurate and complete medical information.
  • Inform your physician about medications, allergies, medical conditions, and relevant medical history.
  • Be truthful about your physical location.
  • Participate in the video visit from an environment that permits appropriate communication with your physician.
  • Follow medical instructions or seek additional care when recommended.
  • Contact emergency services when experiencing a medical emergency.

17. Availability of Services

We attempt to provide timely access to telehealth urgent care, but physician availability and wait times may vary.

We do not guarantee that a physician will be available at a particular time or that every medical condition can be treated through telehealth.

MDs By The Sea may decline, discontinue, or redirect a telehealth encounter when a physician determines that telehealth is not appropriate for the patient's condition.

18. Intellectual Property

The MDs By The Sea name, logos, website content, graphics, written materials, and other original content are owned by or licensed to MDs By The Sea, Inc., except where otherwise indicated.

These materials may not be reproduced, distributed, modified, or used for commercial purposes without authorization from MDs By The Sea, except as permitted by law.

19. Website Availability and Limitation of Liability

We make reasonable efforts to maintain the availability and functionality of our website and technology services, but we cannot guarantee uninterrupted or error-free access.

To the fullest extent permitted by law, MDs By The Sea is not responsible for indirect or consequential losses resulting solely from website outages, internet failures, telecommunications failures, or other technical interruptions beyond our reasonable control.

Nothing in these Terms is intended to waive or limit any patient right or professional obligation that cannot legally be waived or limited.

20. Changes to These Terms

We may update these Terms periodically to reflect changes in our services, technology, business operations, or applicable requirements.

The current version will be posted on this website with the date of the most recent update.

Your continued use of the website after an update constitutes acceptance of the revised website Terms, to the extent permitted by law.

21. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where federal law applies.
